1. Who we are
CrewWorks is software supplied by IT-Feelix (Pty) Ltd (“IT-Feelix”, “we”). The customer is the organisation that buys a plan (“you”). Company registration number and address: see our Legal Notice. IT-Feelix is not VAT registered at the date of these terms.
2. What you get
A licence to run CrewWorks on your own Windows server for the plan you chose, for the number of employees and companies in that plan, plus the set-up described in Section 4 and business-hours support. Updates released for your plan are included while your plan is active.
3. Plans and prices
Plans, employee limits and prices are shown on the CrewWorks page, in rand, with no VAT added. The annual price is the monthly price times 12, paid once a year. Extra companies and extra employees are priced in a quote. We may change prices for new purchases at any time. For an existing customer, a price change applies from the next billing date after we give 30 days' written notice. [Zane to confirm the 30 days]
4. Set-up fee
The set-up fee covers data import, positions and compulsory systems set up, one training session and a go-live check.
- The set-up fee is non-refundable.
- It is paid in three parts: 50 percent up front when you buy, 25 percent once the system is installed (this pays for preparation), and 25 percent once your employees are loaded.
- Starter: R4,750, R2,375 and R2,375. Business: R9,750, R4,875 and R4,875. Group: R19,750, R9,875 and R9,875.
- We invoice the second and third parts when each stage is done and you pay by the payment link on the invoice. [Zane to confirm the number of days to pay each invoice]
- Dates for the stages are agreed with you. Delays caused by you (for example staff data not supplied) do not change the amounts.
5. Plan fees and billing
Monthly plans are charged every month and renew monthly. Annual plans are charged once a year and renew yearly. Both continue until cancelled. The first plan payment is charged when you buy, together with the first part of the set-up fee. Payment is by PayFast. We do not see or store your card details.
6. Cancelling
You can cancel by giving one calendar month's written notice before your next billing date, sent to info@it-feelix.africa. If notice is shorter, one further billing cycle may apply. We confirm in writing the date your plan ends. Cancelling a plan does not refund the set-up fee. This follows our Refunds and Cancellation Policy, which governs.
7. Refunds
Refunds are dealt with as set out in the Refunds and Cancellation Policy. The set-up fee is non-refundable. [Zane to confirm: whether any plan payment already made for a period that has started is refundable]
8. Your responsibilities
- Start the joiner, mover or leaver process for each person, and make sure your administrators, line managers, IT staff and system owners complete their tasks.
- Keep your server, backups and Windows updates in good order, and keep your login details safe.
- Do not share, copy or resell your licence.
- Give us accurate details when you buy and tell us when they change.
9. What CrewWorks does and does not do
CrewWorks assigns, times, reminds and records the removal of access and the issue and return of equipment, and does not close a leaver until every system has a recorded answer. A person records the answer. Today CrewWorks does not itself switch access off in other systems. You remain responsible for making sure access is actually removed in each system. Where we later offer automatic removal as an add-on, this section will be updated.
10. Your data and privacy
CrewWorks runs on your server, so your staff records stay with you. You are the responsible party for that personal information under POPIA. If we access your system to give support, we do so only for that purpose and only with your permission, and we act as your operator. [legal review: operator wording] Our Privacy Policy explains what we collect when you buy, such as your organisation and contact details.
11. Support
Business-hours support (08:00 to 17:00, Monday to Friday, excluding public holidays) is included. Out-of-hours support is available as a paid option. [Zane to confirm the hours]
12. Limits of our liability
Our liability is limited as set out in our Legal Notice. We are not liable for loss caused by access that was not removed in another system, by your server or network failing, or by information you did not give us. Nothing here limits liability that cannot be limited by law. [legal review]
13. Suspension and ending
We may suspend or end your licence if an amount stays unpaid after we have written to you, or if you break these terms and do not fix it after notice. You may still owe amounts that were due. If your licence ends you keep your data on your own server.
14. Governing law and disputes
These terms are governed by South African law. Disputes are first raised in writing to info@it-feelix.africa, and we will try to settle them in good faith before any formal step. [legal review]
15. Changes and acceptance
You accept these terms by ticking the box when you buy. We may update these terms. The version you accepted applies to your purchase, and we give 30 days' written notice before a change applies to an existing customer. [Zane to confirm]
